1. Definitions

For the purpose of these Terms:

You may use PrepMonkey only if:

1. You are 18 years of age or above, or
2. If below 18, you have obtained consent from your parent/legal guardian
3. You are legally competent to enter into a binding contract
4. Your access does not violate any applicable law
5. You have not been suspended or barred from using the Services previously

PrepMonkey assumes all minors using the Platform have obtained parental consent.

We are not responsible for misuse of Services by minors or persons who use incorrect age information.

3. Acceptance of Policies

By using the Platforms:

• You agree to our Privacy Policy, Refund Policy, and all other policies displayed on the Platforms
• You consent to receive communication via email, SMS, WhatsApp, or phone related to our Services
• You agree to Additional Terms applicable to specific Services (e.g., paid plans, AI features)

Where any conflict exists between these Terms and Additional Terms, the specific Additional Terms shall prevail.

4. Registration & Account Responsibilities

Certain features require you to create an account.

You agree that:

• All information provided is accurate and current
• You will maintain the confidentiality of your account and password
• All activity under your account is your responsibility
• You will notify us immediately of unauthorized access

You may not:

• Create more than one active account
• Create an account on behalf of someone else (except parent/guardian for child)
• Share account access with others

We may suspend or terminate your account for violations.

5. Use of Third-Party Login (Google/Apple/etc.)

If you log in using a third-party site ("3P Site"):

• You authorise PrepMonkey to access information from that 3P Site as permitted by their policies
• You are responsible for managing your 3P Site privacy settings
• Disruptions or termination of 3P Site services may affect your access to PrepMonkey
• PrepMonkey is not responsible for any inaccuracies or interruptions caused by 3P Site failures

6. Conduct Rules: What You Must NOT Do

You agree NOT to:

A. Legal and Technical Violations

• Break any applicable law
• Attempt to hack, break, bypass, or disrupt our systems
• Introduce malware, viruses, bots, or automated scripts
• Scrape, crawl, or duplicate PrepMonkey Content
• Reverse-engineer or copy software or proprietary algorithms

B. Misuse of PrepMonkey Content

• Share, distribute, or sell PrepMonkey Content commercially
• Access paid areas without authorization
• Misrepresent or plagiarise solutions, explanations, or AI responses
• Publish or share PrepMonkey's proprietary material without permission

C. Harassment & Abuse

• Stalk, harass, or threaten other Users
• Post abusive, obscene, illegal, defamatory, or hateful content
• Impersonate others

D. Intellectual Property Violations

Do not upload or share content that:

• Belongs to someone else without permission
• Violates copyright, privacy, moral, or proprietary rights
• Includes misleading, false, or harmful information
• Incites violence or violates Indian IT Act rules

E. Misuse of AI Features

• Use AI to generate harmful, illegal, or unethical content
• Attempt to extract system prompts, architecture, or confidential AI logic

Violation of these may lead to account deactivation and legal action.

7. Payments, Subscriptions & Refunds

A. Pricing

• All prices shown at the time of purchase will be honoured
• Taxes may apply as per law
• Prices for recurring plans may change upon renewal

B. Payments

• You authorise PrepMonkey to charge your saved payment method for subscriptions (if applicable)
• Failure to complete payments may result in restricted access or termination

C. Cancellations

• Cancelling a subscription stops future renewals
• Access continues until the end of the billing cycle
• No refunds unless stated under the Refund Policy

D. Refunds

All refunds are governed by the PrepMonkey Refund Policy, displayed on the Platforms.

8. Intellectual Property Rights

PrepMonkey owns all:

• Content
• Tools
• Software
• AI outputs derived from PrepMonkey-owned material
• Designs, logos, and branding
• Product experiences and UX flows

Users receive a personal, non-commercial, limited license to use the Content.

AI Output Ownership

• If input contains PrepMonkey Content, output belongs to PrepMonkey
• If input is fully user-created, the User owns the output
• PrepMonkey is not responsible for legal validation or ownership disputes

Attribution

If User publishes or shares PrepMonkey-derived content publicly, the User must credit PrepMonkey unless explicitly waived.

9. User Content

By uploading or sharing content, you grant PrepMonkey a worldwide, royalty-free, transferable licence to:

• Use
• Process
• Modify
• Display
• Train AI models
• Improve Services
• Publish or market (only if anonymized)

We do not claim ownership over your uploads.

You are responsible for ensuring User Content does not violate any law or rights.

10. Publicity Rights

If a User clears UPSC or any exam using PrepMonkey, PrepMonkey may:

• Display their name, rank, or testimonial
• Showcase them as a successful user

unless the User opts out by writing to connect@prepmonkey.com.

11. Third-Party Services

PrepMonkey uses third-party tools for payments, AI, analytics, hosting, and content delivery.

Use of these services is governed by their respective policies.

PrepMonkey is not responsible for third-party failures or issues.

12. Termination

PrepMonkey may suspend or terminate your account if:

• You violate these Terms
• You misuse the Services
• You engage in harmful or fraudulent behaviour

You may stop using the Services anytime by deleting your account.

Upon termination:

• Certain rights survive (IP, privacy, dispute resolution, etc.)
• No refunds are provided unless required by law

13. Disclaimer of Warranties

PrepMonkey is provided on an "as is" and "as available" basis.

We do NOT guarantee:

• Error-free operation
• Perfect accuracy of AI responses
• Guaranteed exam results
• Uninterrupted access
• Freedom from bugs or vulnerabilities

All preparation decisions must be made by the User.

14. Limitation of Liability

To the fullest extent permitted by law:

PrepMonkey and its Parties will NOT be liable for:

• Loss of data
• Lost profits
• Damages from exam failure
• Loss caused by third parties
• Any indirect, incidental, or consequential damages

Total liability (if any) is limited to: The amount paid by the User in the last 12 months.

15. Indemnification

You agree to indemnify and hold harmless PrepMonkey and PrepMonkey Parties from losses arising due to:

• Violation of Terms
• Misuse of the Platforms
• Unlawful use of Content
• IP violation
• Misrepresentation

This obligation survives termination.

16. Governing Law & Dispute Resolution

These Terms are governed by the laws of India.

Any disputes shall be resolved through:

Arbitration

• Seat: Hyderabad, Telangana
• Language: English
• Arbitrator: Sole arbitrator mutually appointed

Courts at Hyderabad, Telangana shall have exclusive jurisdiction.

18. Miscellaneous

• No waiver: Failure to enforce any clause does not waive rights
• Severability: Invalid clauses do not affect remaining Terms
• Assignment: Users cannot assign rights; PrepMonkey can
• Modifications: Terms may be updated anytime with notice
